 Storage Terms and Conditions:
These are the terms and conditions on which we supply our services to you, and explain the rights, obligations, and responsibilities of all parties.
 
Definitions
For the purposes of this agreement, the following definitions shall apply.

“Access Hours” Please see ‘Opening Hours” Tab on BBC Storage website.
 
“Agreement” Includes these terms & Conditions of Agreement BBC Storage Pty Ltd agreement.
 
“Facility” Means the Building, Warehouse, External storage or other Landor premises owned, leased, or operated by the Facility                  Operator
 
“Property” or Your Property or Goods or Chattels means any or all goods stored by you in a storage space allocated to you at                       Our Facility
 
 “Replacement Value" means the current cost of replacing Your Property as new, except for motorcars, motorbikes, boats,                             caravans, motorhomes and, where the Replacement Value allows for the age, degree of use, existing damage, and consequent market value.
. any Goods which cannot be purchased new (such as antiques or works of art, for example), where the Replacement Value shall be the current market value; and
. documents, where the Replacement Value shall be the physical cost of replacing re-issue or reconstitution, but excluding the information contained in the documents.

"Maximum Replacement Value" means the maximum sum total of the Replacement Value For all Property at any time throughout the period of storage.

"Loss" or "Damage" means identifiable losses and direct physical destruction of or damage to Your Goods, caused by wilful acts, omissions, and default, including theft by forcible entry or damage while the Goods are in the Unit.

"Storage Costs" means the Storage Costs stated in the Storage Agreement

"We", "Us", "Our" means the Facility Operator, its employees, agents, or representatives.

"You" or "Your" means the customer named in this Agreement.
 
 
 
OUR SERVICES TO YOU:
 

1. So long as all fees are paid up to date and subject to these Conditions: (a) We will make available to You a segregated area of Our Facility for You to store your Bike, Boat or Caravan; (b) You are granted a license during the Storage Period to store Goods in the area allocated to You by Us from time to time and only in that area; (c) We will maintain the Facility in a secure and safe condition; and (d) We will make every reasonable effort to protect Your Property from Loss or Damage while your Goods remain in Our care,

2. We do not grant any lease or tenancy of the Unit or any part of the Facility and nothing in this Agreement creates a landlord and tenant relationship. We retain control, possession and management of the Facility and the Unit and the You have no right to exclude Us from the Facility or the Unit.

3. If You wish to accept any additional services We offer, such as delivery and collection, we will provide details separately. You will need to sign up to Our terms and conditions for such services which may be subject to additional charges.
    

3.0  Costs & Fees 

3.1 The storage fees are invoiced and payable in advance. They are due within 7 days of invoicing. If you fail to pay any or all of the amounts payable to you under these terms and conditions, by the date such amounts are due, BBC STORAGE PTY LTD reserves the right to charge interest at a rate of 2% per annum above the Business Overdraft rate set by the Reserve Bank, calculated daily on the amount outstanding from the date the amount was due until the date the amount is paid

 
4. Risk & Insurance:
The client must insure and keep insured their Goods for the full replacement value and for their storage at the premises with any rights of subrogation of the relevant insurer waived as against BBC STORAGE PTY LTD and its insurers. BBC STORAGE PTY LTD are not liable for any damage or stolen goods from the premises. The client must provide a certificate of currency listing the premises as evidence of the insurance over the goods. This must be provided prior to storage and payment of the 1st Monthly invoice. BBC STORAGE PTY LTD are not liable for any damage or stolen goods from the premises.
 
5. Outstanding Payment
If payment is defaulted or not made within 30 days of the monthly invoice, BBC STORAGE PTY LTD may give you 14 days’ notice of its intention to sell any or all the goods at your cost, by public auction or private treaty. If all of the amounts outstanding are not paid within the period specified in the notice, BBC STORAGE PTY LTD may apply the net proceeds of any such sale to the amounts outstanding and return the balance of the proceeds, if any to you less an administration fee of $1,000.
 
6. TERMINATION
BBC STORAGE PTY LTD or the client may terminate the storage period by giving the other party 30 days written notice.

BBC STORAGE PTY LTD may immediately terminate the storage period by giving written notice if you breach these terms and conditions and fail to remedy the breach within 7 days of receiving written notice from BBC STORAGE PTY LTD to remedy the breach.

On expiry or termination of the storage period you must immediately pay BBC STORAGE PTY LTD all amounts owing. If the storage period is terminated by you or BBC STORAGE PTY LTD you must also pay the charges from the date of the termination until the end of the storage period.

7 Notices
All notices must be in writing and given by email or registered post to the addresses of the parties set out in the invoice or to the address designated by a party by written notice.
 
8 Warranties
You warrant that: - 
a.   You have the authority to enter into this agreement – 
 
b.   If the goods are subject to any financial interest whatsoever you undertake to disclose that interest in full before signing the             agreement for storage
c.You are the beneficial owner of the goods or have the authority of the beneficial owner of the goods to deal with the goods in          accordance with these terms and conditions – 
 
d. The goods are not stolen and have not been illegally obtained, and are not the subject of any court order, judgment, writ of       execution, proceeding, or dispute. You will comply with all laws in connection with the goods –
 
e. BBC STORAGE PTY LTD has not made any warranty or representation as to the suitability of the premises (whether because of its location, facilities, or temperature) for the storage services or any equipment or material used in connection with the storage services – 
 
f. The goods are not and do not contain live animals or organisms, substances which are dangerous, hazardous, illegal, noxious, corrosive, explosive, suffocating, inflammable or in any other way dangerous to a person’s health or safety or property or anything or substance which may encourage any vermin or pests.

9. Storage Requirements:
The storage facility is for Bikes Boats Caravans, camper trailers RVs and motorhomes only.
 
10. PICK UP & DELIVERY
24 hours’ notice is required before any item can be delivered or collected from the site and there will be a flat charge of $90 plus GST. (To cover time Locating, Tyre pressure checks Hook up removing from storage location and positioning on main access road ready for pickup) And only between the operating business hours as advised from time to time or displayed on our website, currently 9am to 4pm Mondays to Fridays. There may be an additional charge for weekend deliveries or pickups. We will also provide additional services such as Cleaning, Wheel bearing servicing or replacement, pick up and delivery services within reasonable distances but goods will never be left unattended All extra services will depend on agreed fees based on distance size or estimated time and form part of your costs and fees.
